US DOL Wage and Hour Division: Step-by-Step

Document Your Hours and Pay

Before filing, gather all records you have: payslips, bank statements showing deposits, any text messages or emails about scheduled hours, handwritten time logs, screenshots of scheduling apps. You do not need a complete record to file a complaint -- the DOL investigator will gather employer records -- but the more documentation you have, the stronger your case.

File a Complaint with the Wage and Hour Division

File online at dol.gov/agencies/whd/contact/complaints, by phone at 1-866-487-9243 (free, confidential), or in person at your nearest WHD district office. There is no filing fee. Complaints are confidential by law -- your employer cannot be told you filed unless you consent. You can also file an anonymous tip.

The WHD Investigates

An investigator contacts the employer, reviews payroll records, interviews employees (confidentially), and determines if violations occurred. This can take weeks to months depending on complexity and caseload.

What You Can Recover

Back wages (the underpaid amount) plus liquidated damages of an equal amount -- effectively doubling your recovery. Liquidated damages are automatic unless the employer proves it acted in good faith and had objectively reasonable grounds for believing its pay practices were lawful. Attorney fees may also be recoverable in litigation.

Statutes of Limitations

Standard FLSA violation: 2 years from the date wages were owed. Willful violation (employer knew it was violating the law): 3 years. Many states have longer statutes -- California allows 3-4 years for minimum wage claims.

FLSA COLLECTIVE ACTION

Multiple Workers Can File Together

FLSA section 216(b) allows workers to bring a "collective action" -- a lawsuit where one or more workers sue on behalf of themselves and similarly situated colleagues. Unlike a class action (which is opt-out), an FLSA collective action requires each additional worker to affirmatively opt in. If your employer has underpaid multiple workers in the same way (e.g., failing to pay for pre-shift time, applying an illegal deduction), a collective action can make it economical for lawyers to take the case and maximise recovery. Many employment law firms take FLSA collective actions on contingency.

HMRC Investigates the Employer

HMRC sends compliance officers to inspect employer payroll records, interview workers, and review time records. Employers are required to keep adequate pay records for at least 3 years. Workers may be interviewed confidentially.

Notice of Underpayment

If HMRC finds a violation, it issues a Notice of Underpayment. The employer must repay all arrears to the worker within 28 days and pay a civil penalty of 200 percent of the arrears to HMRC (capped at £20,000 per worker affected). For persistent or deliberate underpayers, criminal prosecution is possible.

Public Naming Scheme

Employers found to have underpaid the NMW are publicly named on the government's Naming and Shaming scheme, published twice per year. Since 2013 over 3,000 employers have been named. Named employers must also pay the arrears and penalty.
